These terms of sale apply to the paid plans of LucidStack, sold by Jonathan Margotin, Entrepreneur individuel (EI), SIREN 917 538 845, 4 cour du Pavillon, 72290 Souligné-sous-Ballon, France (the "Publisher"). They complete the terms of service.
This translation is provided for convenience; the French version prevails.
1. Customers
The paid plans are open to professionals (companies, freelancers, associations) and to consumers. The provisions that only concern consumers are stated as such.
2. Plans and prices
- Solo · 9 € / month or 90 € / year
- Agency · 24 € / month or 240 € / year
- Pro · 49 € / month or 490 € / year
- Options · 50 more monitors 5 € / month, one more server 2 € / month
Prices are in euros. VAT is not applicable (article 293 B of the French tax code): the price shown is the price paid. The content and limits of each plan are described on the pricing page, in force on the day of the subscription.
3. Subscription and payment
The subscription is made from the billing page of your account, after filling in your billing details. It is paid by card or SEPA debit through Stripe, monthly or yearly, in advance. Each payment gives rise to an invoice, sent by e-mail and available in your account.
4. Duration and cancellation
The subscription is renewed automatically for the chosen period (month or year), without commitment beyond it. You can cancel it at any time from your account: it ends at the end of the period already paid, which is not refunded, and your account then returns to the free plan.
5. Change of plan and options
A change of plan, cycle or options applies immediately. The difference is calculated prorata temporis: invoiced at once for an increase, deducted from the next invoices for a decrease.
6. SMS credits
SMS alerts are paid with prepaid credits, sold in packs on the paid plans; one credit is used for each message sent. Credits do not expire and are not refunded.
7. Unpaid invoices
If a payment fails, Stripe tries again during the following days and you are informed by e-mail. After 14 days without payment, only the quotas of the free plan apply; after 30 days, the subscription ends. Existing monitors keep running.
For professionals, late payment penalties at three times the French legal interest rate are due, as well as a fixed compensation of 40 euros for recovery costs (articles L441-10 and D441-5 of the French commercial code).
8. Right of withdrawal (consumers)
A consumer has fourteen days from the subscription to withdraw, without giving any reason, by writing to contact@lucidstack.dev. By starting to use the service before the end of this period, the consumer asks for it to start immediately; in case of withdrawal, the part of the service already provided is due and the rest is refunded within fourteen days.
9. Liability
The Publisher is bound by a best-effort obligation. Its liability, when engaged, is limited to the amounts paid by the customer during the twelve months preceding the event, and excludes indirect damages such as loss of revenue. This limitation does not apply to consumers where the law forbids it.
10. Disputes
In case of dispute, write first to contact@lucidstack.dev to find an amicable solution.
These terms of sale are governed by French law. Failing an amicable solution, the competent French courts have jurisdiction; for professionals, those within the jurisdiction of the Publisher's registered office.
